Neutral, independent portal for finding property managers
These Terms and Conditions (hereinafter the "AGB") govern the use of the internet platform "Deutsches Verwalterportal" (hereinafter the "platform"). The platform is operated by JS Advertising GmbH (hereinafter "we" or the "provider"). The provider's contact and register details can be found in the Legal Notice (Impressum).
These AGB apply to the use of the platform by owners, homeowners' associations (Wohnungseigentümergemeinschaften, WEG) and other persons searching for a property management company (hereinafter "users"), as well as to the use of the publicly accessible directory and the enquiry form.
The users' contracting party is exclusively JS Advertising GmbH. By using the platform, users accept these AGB in the version applicable at the time of use.
Separate terms for the purchase of enquiries (leads) for a fee, for verified profiles or for quality seals by property management companies are not the subject of these AGB. These are governed by their own, separately agreed terms.
The platform brokers contacts between users looking for a property management company and property management companies from the relevant region. Users can state their requirements via an enquiry form and then receive contact with, or offers from, property management companies.
JS Advertising GmbH itself provides no property management services and is not a representative or vicarious agent of the listed or referred property management companies. It acts exclusively as an intermediary, that is, it establishes the contact.
Any management, service or other contract is concluded solely between the user and the respective property management company. JS Advertising GmbH does not become a party to this contract.
The directory of property management companies maintained on the platform serves exclusively for information and orientation. An entry in the directory does not constitute a recommendation and makes no statement about the suitability of the respective property management company in a specific individual case.
Use of the platform and enquiries via the form are free of charge and non-binding for users. The platform is financed by the property management companies.
Use of the platform and the submission of an enquiry do not give rise to any payment obligation for users, nor to any obligation to conclude a contract with a property management company.
Users can search the directory and describe their requirements via the enquiry form. On the basis of the information provided, we forward the enquiry to suitable regional property management companies, provided the users have consented to this. Details of the data processing and of the transfer of the enquiry to property management companies are set out in the Privacy Policy.
At no time are users obliged to accept an offer received or to conclude a contract. The decision on the selection and engagement of a property management company rests solely with the user.
JS Advertising GmbH owes its efforts to broker contacts, but not a specific outcome. In particular, there is no entitlement to contact being established, to a specific number of offers being transmitted, to offers being received within a specific period, or to a contract with a property management company being concluded.
JS Advertising GmbH gives no assurance and no guarantee with regard to the quality, suitability, reliability or proper performance of the listed or referred property management companies.
The directory contains information on property management companies that we compile from publicly accessible sources, from association and member lists, from our own research and from open data sources. A property management company's inclusion in the directory does not depend on whether it uses the platform for a fee.
Within the directory, we make a recognisable distinction between entries that are merely listed and entries that have been vetted ("geprüft") in accordance with a vetting standard published by us. We mark paid or verified entries as such; a paid placement is not presented as a neutral result.
Property management companies and other data subjects may request the rectification, completion or erasure of their entry and may object to their inclusion in the directory. The contact channel and the procedure for this are described in our Privacy Policy; we implement justified requests promptly.
The content of the platform, in particular texts, design, editorial contributions and the structure and compilation of the directory, is legally protected. Any use beyond the intended use of the platform, in particular the reproduction, distribution or systematic extraction (scraping) of the directory data, requires our prior consent.
Where users submit their own content (such as information in the enquiry form), they grant us the right to process it in the context of the referral described in Clause 2 and in accordance with the Privacy Policy.
We endeavour to operate the platform with as few disruptions as possible. However, there is no entitlement to uninterrupted availability. Availability may be temporarily restricted, in particular by maintenance work, technical faults or circumstances beyond our control. Maintenance windows are permitted.
JS Advertising GmbH has unlimited liability in cases of intent and gross negligence, for injury to life, body or health, and under the provisions of the German Product Liability Act (Produkthaftungsgesetz).
In cases of simple negligence, JS Advertising GmbH is liable only for the breach of a material contractual obligation (that is, an obligation whose fulfilment is essential for the proper performance of the contract in the first place and on whose observance the contracting partner may regularly rely). In this case, liability is limited to the foreseeable damage typical of this type of contract.
In all other respects, the liability of JS Advertising GmbH is excluded. The above limitations of liability also apply in favour of the legal representatives and vicarious agents of JS Advertising GmbH.
In particular, JS Advertising GmbH is not liable for the services, offers, information or conduct of the referred or listed property management companies. These are independent providers; the respective property management company alone is responsible for its performance and for the contracts concluded between the user and the property management company.
Information on the processing of personal data, in particular on the transfer of enquiry data to property management companies and on the rights of data subjects, is contained in our Privacy Policy. An enquiry is passed on to property management companies in accordance with the legal bases described there, in particular on the basis of your consent.
We reserve the right to amend these AGB with effect for the future where this is necessary for a valid reason, for example because of a change in the legal situation, in supreme court case law or in the functional scope of the platform, and where users are not unreasonably disadvantaged as a result.
For the free use of the platform, which is not designed to be permanent, the version of these AGB published on the platform at the time of use applies in each case. Where, by way of exception, an ongoing usage relationship exists between a user and JS Advertising GmbH, we will inform the user of intended amendments in text form; the amendments are deemed to have been approved if the user does not object to them within a reasonable period stated in the notification. In the notification, we will make specific reference to the significance of silence and to the right to object.
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user, as a consumer, has their habitual residence remain unaffected.
With respect to consumers, the statutory place of jurisdiction applies. We do not enter into any deviating jurisdiction agreement with consumers.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Should individual provisions of these AGB be or become wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions. The statutory provision shall apply in place of an invalid or unenforceable provision.
