Wallbox in a WEG: Why the resolution is rarely the problem

Since the WEMoG reform, every apartment owner has had a statutory right to install a charging point, so the whether is settled. Yet in many owners' associations the issue is stuck, namely on the how.

Anyone who wants a wallbox (EV charging point) in their condominium owners' association (WEG) usually braces for resistance: a long debate at the owners' meeting, neighbors who do not drive an electric car and therefore have no interest, a narrow vote. The worry is understandable, it just aims at the wrong point. Legally, the matter has been settled for years. The difficulty starts afterwards.

The whether is no longer up for debate

With the WEMoG, Germany's condominium law reform, the legislator created an entitlement in December 2020: every apartment owner can demand to be permitted a charging facility for an electric vehicle (Section 20 (2) no. 2 of the German Condominium Act, WEG). The association can no longer prevent it. It can only decide on the how, meaning the specific execution: where the cabling runs, which technology is used, what the result looks like.

The costs are borne by whoever demands the measure. If you want the wallbox, you pay for it. That is why in practice the resolution is rarely the problem: the association is deciding neither on the whether nor about its own money. Where things actually get stuck

The hard part begins with the questions no law answers:

  • Is the building's grid connection sufficient at all once not just one but, later on, five owners want to charge?
  • Who plans the load management, meaning the distribution of the available power across several charging points?
  • How is the charged electricity metered and billed?
  • Who obtains quotes, coordinates the electrical contractor and talks to the grid operator?

This is not legal work but project work, and as a rule it ends up with the property management company. This is exactly where the difference arises between an association where the first wallbox is on the wall after a few months and one where the topic wanders from meeting to meeting.

Plan once for everyone instead of five times individually

The most important practical advice is therefore: whoever asks first should think for everyone. An overall concept for the building, meaning a shared supply line with load management that further charging points can later be added to, is almost always cheaper than five individually retrofitted connections. Every wallbox planned on its own brings its own cable runs, its own call-out charges and, at some point, the realization that the connection is not sufficient after all.

For the association this means: the first application is the opportunity to settle the question properly once instead of postponing it. For choosing a property manager it means: ask. Useful questions for the selection interview are therefore concrete:

  • Have you ever supported a charging concept for an apartment building?
  • Who did the load calculation there, you or an external planner?
  • Which electrical contractors do you work with?
  • How do you bill the charging electricity?

Anyone who answers these concretely rather than in general terms has done it before. In the end that is more useful information than any debate about the resolution, because that is settled anyway.
